Ola Pro Terms and Conditions for Drivers

  • Definitions

A)Driver Completion Rate means the rate of successfully completed trips (successfully completed trip being a successful pick up and drop off of a passenger) through the Ola app during the Term subject to any limitations or conditions set out in these terms and conditions

B)Expiry Date means the last day of the Ola Pro Program, such day and date being made known to you in writing by Us at any time hereafter

C)Health and Safety Requirements mean the requirements set out in clause 8

D)Launch Date means 22 April 2020 or such other date as We may notify You or publish on our website at ola.com.au from time to time

E)Minimum Thresholds means the login and completion rate thresholds set out in clause 9

F)Ola Cleaning Centre means the premises located at RideCare, 35 Rosedale Street, Greenacre, NSW, 2190, or any other address that We might direct You to from time to time and managed by RideCare or any other provider as We may notify You from time to time

G)Ola Pro Driver means a current Ola Driver who meets the eligibility criteria to be a driver for Ola Pro in these terms and conditions and continues to meet such criteria

H)Ola Pro Program means this super sanitised program launched by Us, the details of which can be found on our website at www.ola.com.au

I)Opt In Link means the expression of interest link used by Us to determine Your intention to particulate in the Ola Pro Program

J)Preliminary Requirements mean the requirements set out in clause 6

K)Program Criteria means the criteria

L)RideCare means RideCare Pty Ltd ACN 624 998 974

M)Term means the term of the Ola Pro Program set out in clause 3

N)You or Your means the driver

O)Weekly Requirements mean the requirements set out in clause 7

P)We, Us or Our means Ola Australia Pty Ltd

  • Driver agreement

A)These terms and conditions do not override or replace the Driver Agreement with Us

B)In order to be an Ola Pro Driver, You must continue to comply with the Driver Agreement

  • Term

A)The Ola Pro Program commences on Launch Date and continues until its Expiry Date

B)We may shorten the term in Our sole discretion

  • Participation

A) Any current Ola driver who meets, and continues to meet, the terms of registration as an Ola driver and who complies with the Driver Agreement is eligible to participate in the Ola Pro Program

B)You are required to expressly opt into the Ola Pro Program by clicking the Opt In Link

C)We will, in Our sole discretion, select any driver who has opted in to participate in the Ola Pro Program

D)We may extend the offer to You to participate in the Ola Pro Program. You may choose to accept or reject the offer to participate

E)The Ola Pro Program will only be available in addition to the Ola Sedan category but will not be available in conjunction with Ola SUV or Ola Premium ride services. Opting In to Ola Pro will remove Ola SUV and/or Ola Premium from Your profile while you remain an Ola Pro Driver

F)If You choose to participate, You acknowledge that the Ola SUV and Ola Premium ride services will not be available to You for the duration of Your participation in the Ola Pro Program

G)If You choose to participate, You may opt out of the Ola Pro Program at any time. You will not be penalised for exiting from the Ola Pro Program

H)If you exit the Ola Pro Program, You will continue to be eligible to drive for Ola outside of the Ola Pro Program including the Ola SUV and Ola Premium ride services as Our current Ola driver (subject to any requirements under the Driver Agreement and any other applicable policies and requirements of Ola)

  • Program Criteria

A)To participate in the Ola Pro Program and to remain as an Ola Pro Driver, you are required to meet the following Program Criteria:

i. Accept Our offer to participate in the Ola Pro Program by expressly opting into the program using the Opt-In Link

ii.Comply with the Preliminary Requirements set out in clause 6

iii.Comply with the Weekly Requirements set out in clause 7

iv.Comply with the Health and Safety Requirements set out in clause 8

v.Comply with the Minimum Threshold set out in clause 9

  • Preliminary Requirements

A)Prior to starting to drive on the Ola Pro Program, You must have met all the Preliminary Requirements set out in this clause

B)Transparent hygiene screen – Your vehicle must be fitted with a transparent hygiene screen with an approved provider at an Ola Cleaning Centre. By participating in the Ola Pro Program, You consent to and accept that the fitting of the transparent hygiene screen may inadvertently cause minor wear and tear on the touching surfaces of Your vehicle’s upholstery

C)In order for Your vehicle to be fitted, You must schedule an appointment to visit an Ola Cleaning Centre and must visit the Ola Cleaning Centre at the appointed time and date

D)You agree and acknowledge that:

i. The transparent hygiene screen (screen) is provided to You for the sole use of the Ola Pro Program and when driving for Us while on the Ola Pro Program

ii.You must not use the screen for any other purpose

iii.You must not remove the screen unless You inform us in writing by emailing to Care.Australia <care.australia@olacabs.com> that You no longer wish to participate in the Ola Pro Program AND we have provided You with directions as to the removal of the screen

iv.In the event that the screen is torn or is otherwise damaged, You must promptly report the same to Us by calling or CONTACT us whereby We will provide you with directions as to repair requirements.

v.If the integrity of the screen is compromised (for example, it’s broken or removed), you will be temporarily downgraded as an Ola Pro Driver. Upon the screen being replaced and reattached, you will be able to resume driving as an Ola Pro Driver.

E)Driver hygiene pack – have available a full driver hygiene pack consisting of the following items:

i.Disposable gloves;

ii.Masks;

iii.Hand sanitisers; and

iv.If available, anti-bacterial wipes

F)A full and complete driver hygiene pack will be provided to You on your first visit to the Ola Cleaning Centre

G)You agree and acknowledge that:

i.The driver hygiene pack is provided to You for the sole use of the Ola Pro Program and when driving for Us while on the Ola Pro Program

ii.You must not use the pack for any other purpose

iii.You must limit the use of each item in the pack as follows:

1.One (1) mask per day

2.(Where available) one (1) bacterial wipe on key areas such as armrest, window buttons, door handles of your vehicle

3.One (1) pair of disposable gloves used only for the purpose of such wipe down

4.One (1) bottle of hand sanitiser per week

  • Weekly Requirements

A)You are required to meet the following Weekly Requirements set out in this clause to remain on the Ola Pro Program

B)Weekly vehicle clean – visit an Ola Cleaning Centre once a week for vehicle cleaning at the confirmed appointment time

C)You must schedule a time and date for the appointment and must visit the Ola Cleaning Centre at the appointed time and date in order to have Your vehicle cleaned

D)The appointment must be scheduled at least a week in advance of the appointment by either:

i.Calling or emailing Us at Care.Australia <care.australia@olacabs.com>; or

ii.Booking an appointment with Us through the Ola app (if and when this feature becomes available)

E)The weekly vehicle clean must be performed using the cleaning products made available by RideCare. By participating in the Ola Pro Program, You consent to the use of these products on Your vehicle

F)You must reschedule any missed vehicle cleaning appointments within a 24 hour period

G)If you miss a total of three (3) car cleaning appointments, You will be permanently removed from the Ola Pro Program

H)Driver hygiene pack restock – You must promptly notify Us by calling or emailing Us at Care.Australia <care.australia@olacabs.com> if you run out of any items in the driver hygiene pack

I)Where available, We will restock the items you may require subject to availability. Otherwise, You will be required to source and supply items of equivalent standard at Your own cost (within reason)

J)You acknowledge that We have no obligation nor any responsibility to restock any items in the driver hygiene pack that was provided to You in accordance with the Preliminary Requirements outlined in clause 6(h)

K)Temperature checks – You consent to having Your temperature checked by a representative of the Ola Cleaning Centre once a week at the Ola Cleaning Centre each time you visit the centre for your weekly vehicle clean appointments

L)If at any point your temperature registers that You have a fever (in accordance with the relevant product specification) You will be deemed unfit to drive and will be suspended from the Ola platform until such time you are able to provide Us with a certificate from a registered medical practitioner that you are deemed fit for work

  • Health and Safety Requirements

A)You are required to meet the following Health and Safety Requirements set out in this clause to remain on the Ola Pro Program

B)Vehicle requirements – You must maintain a properly fitted and undamaged transparent hygiene screen at all times

C)Daily hygiene practice – You must maintain proper hygiene practices in accordance with the Australian Federal and relevant State and Territory governments’ department of health guidelines each day You are driving under the Ola Pro Program

D)Such guidelines include the following:

i. Self-isolation and social distancing requirements

ii.Clean all of the following: door handles, steering wheel, seat belts and buckles, seats, dashboard, gear stick, windows and mirrors at the start and end of every trip

E)You understand and agree that We are providing this service in response to the global COVID-19 pandemic. We are not a medical authority and if at any time You feel unfit to drive due to flu or COVID-19-ke symptoms, You must notify Ola and comply with the Australian Federal and relevant State and Territory governments’ department of health guidelines regarding the treatment of COVID-19

  • Minimum Thresholds

A)You must meet the Minimum Thresholds set out in this clause to remain on the Ola Pro Program

B)You must log on the Ola app for 50 hours over a one (1) week period commencing on a Monday and ending on a Sunday while participating in the Ola Pro Program

C)You must have a Driver Completion Rate of at least 75% for the duration of Your participation in the Ola Pro Program

D)If You cancel or fail to successfully complete a ride, that ride will not apply to your Driver Completion Rate

  • Termination

A)Non-compliance with any of these terms and conditions may result in You being removed from the Ola Pro Program

B)We reserve the right to amend or cancel any terms of the Ola Pro Program herein, any requirements set under the Program or withdraw the program from the Ola platform at any time

  • Relationship

A)The Ola Pro Program in no way guarantees a minimum income from Ola and You will operate and have the status of an independent

B)The relationship between Us and You is on the basis of two independent contractors contracting for mutual benefit and nothing in these Terms and Conditions or the Driver Agreement will be interpreted as creating the relationship of employer and employee between Us and You at any time, under any circumstances or for any purpose

C)Ola has the right to select only certain drivers to become Ola Pro drivers. The criteria for selection is solely at Our discretion

D)In addition to the terms and conditions listed here, You are required to comply with the conditions outlined in the Driver Agreement. Nothing in these terms and conditions terminates or waives the:

i.The rights of a Driver and Ola under the Driver Agreement;

ii.The obligations that a Driver and Ola have to each other under the Driver Agreement;

iii.Any onboarding, vehicle or insurance requirements under the Driver Agreement
